Frances Diaz v. Oakwood University, Inc.

To:      All individuals within the United States (1) whose Personal Information was stored, possessed or controlled by Oakwood; and (2) who were notified by Oakwood of the Data Security Incident. 

 

A proposed settlement has been reached in the class action lawsuit titled, Frances Diaz v. Oakwood University, Inc., No. 47-cv-2023-901196.00 (the “Litigation”).  The Litigation asserts claims against Defendant Oakwood University, Inc. (“Oakwood” or “Defendant”) related to a security incident that occurred between March 7 to March 14, 2022, and about which Defendant notified potentially impacted individuals on October 1, 2022 (the “Data Security Incident”). Defendant denies all of the claims and denies it did anything wrong.

 

The settlement offers reimbursements and credit monitoring services to all individuals within the United States (1) whose Personal Information was stored, possessed or controlled by Oakwood, and (2) who were notified by Oakwood of the Data Security Incident. Settlement Class Members may make a Settlement Claim for: (i) credit monitoring services, (ii) an Award for lost time, and (iii) an Award for Out of Pocket Expenses.

 

(1) Credit Monitoring Services: Settlement Class Members are eligible to receive 12 months of free three-bureau credit monitoring.

(2) Lost Time Award: Settlement Class Members may be eligible to receive reimbursement for up to three (3) hours of lost time spent dealing with the Data Security Incident (at the rate of $25 per hour), but only if at least one (1) full hour was spent dealing with the Data Security Incident. You may also request and receive reimbursement up to an additional three (3) hours of lost time, as explained below. 

(3) Out of Pocket Expenses: Settlement Class Members who incurred unreimbursed Out of Pocket Expenses as a result of the Data Security Incident may be eligible to receive an Award consisting of reimbursement of up to $5,000.

Submit a Claim Form

Deadline: June 2, 2024

You must submit a valid Claim Form to receive a payment from this settlement.
Do NothingYou will Receive no payment and will no longer be able to sue Defendant over the claims resolved in the settlement.

Exclude Yourself

Deadline: June 2, 2024

You may exclude yourself from this settlement and keep your right to sue separately. If you exclude yourself, you receive no payment. Exclusion instructions are provided in FAQ 15.

Object

Deadline: June 2, 2024

If you do not exclude yourself, you may write to the Court to comment on or detail why you do not like the settlement by following the instructions in this Class Notice. The Court may reject your objection. You must still file a Claim Form if you desire any monetary relief under the settlement.

 

The Court must give final approval to the Class Settlement Agreement before it takes effect but has not yet done so. No payments will be made until after the Court gives final approval and any appeals are resolved.
